We also may collect information regarding customer activities on our website and from our other products and services.

This information is aggregated and used to provide more useful products to our customers by helping us understand which parts of our website, devices, and services are of most interest. CleverPet may also display this information publicly or provide it to others. However, CleverPet does not disclose personally-identifying information.

If you send us a support request, we reserve the right to publish the non-personally identifiable parts of it in order to help us clarify or respond to your request or to help us support other users.

Personally Identifying Information

CleverPet also collects personally identifying information – data in a form that permits direct association with any specific individual. This type of information helps us provide better support for all of our users.

We use various technologies to collect and store information when you use a CleverPet product or service, and this may include sending one or more cookies or anonymous identifiers to your device.

The personal information we collect allows us to keep you posted on CleverPet’s latest product announcements, software updates, and upcoming events. It also helps us develop, deliver, and improve our products and services by giving us data that can be internally analyzed and audited.

From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies.

Protecting Personally Identifying Information

CleverPet discloses potentially personally-identifying and personally-identifying information to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on CleverPet’s behalf, for example a postal carrier requires shipping information to make a delivery, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using CleverPet’s products and services, you consent to the transfer of such information to them. CleverPet will not rent or sell potentially personally-identifying and personally-identifying information to anyone.

CleverPet takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Disclosure of Personal Information to Third-Parties

If CleverPet, or substantially all of its assets, were acquired, or in the event that CleverPet goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of CleverPet may continue to use your personal information as set forth in this policy.

Other than to its employees, contractors and affiliated organizations, as described above, CleverPet discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when CleverPet believes in good faith that disclosure is reasonably necessary to protect the property or rights of CleverPet, third parties or the public at large.

Third-Party Privacy Policies

CleverPet’s products, services and websites may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties. Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

Child Privacy Policy and Parental Consent Statement

CleverPet wants to protect the safety of children using its products, services, and websites. To the extent applicable, CleverPet complies with applicable laws and regulations, including the Children’s Online Privacy Protection Act (COPPA), which governs information gathering online from or about children under the age of 13. Verifiable consent from a child’s parent or guardian is required before collecting, using, or disclosing personal information from a child under the age of 13.

Consistent with the requirements of COPPA, in any instance where CleverPet asks for age and determines the user is under the age of 13, CleverPet will require a parent or guardian email address in order to send a consent form to the parent/guardian for verifiable consent before CleverPet collects any personal information from children under the age of 13.

Without obtaining verifiable parental consent, online contact information collected from a child is only used to communicate directly to the child for the purpose of responding to their inquiry or to obtain verifiable consent. If verifiable consent is not obtained, 30 days from when the original online contact information was received, this information will be removed from CleverPet's records and the child will not be contacted.

In addition to obtaining verifiable consent according to the process described above, CleverPet does NOT:

  1. collect personally identifiable offline contact information of a child under age 13 without prior parental consent.
  2. provide any personally identifiable information, regardless of its source, to any third-party for any purpose whatsoever concerning our Users under 13 years of age, unless otherwise disclosed to children and their parents during the information collection process.
  3. give children under age 13 the ability to publicly post or otherwise distribute personally identifiable contact information without prior parental consent.
  4. entice any child by the prospect of a special game, prize, or other activity to divulge more information than is needed to participate in the activity.

There are several exceptions that permit collection of a child’s e-mail address without receiving parental consent in advance:

  • To provide the parents with notice and to seek consent for communications with the child. Note: this may require collection of the parent’s e-mail address as well.
  • To protect the safety of a child who is participating on the site; i.e., in a message board
  • To protect the Website or to respond to law enforcement; i.e., in the case of a Website compromise.

California Privacy Rights

Residents of California have the right under California law to request from any company conducting business in California a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes. If, however, the company has a privacy policy that gives either an opt-out or opt-in choice for use of your personal information by third parties (such as advertisers) for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options.

CleverPet does not knowingly provide your personal information to third parties for direct marketing purposes. Additionally, we provide you the option to opt-out regarding the use of your personal information by third parties for direct marketing purposes by sending us an e-mail so stating. Because we provide you the option to opt-out regarding the use of personal information by third parties for direct marketing purposes, we are not legally required to maintain or disclose a list of the third parties that received your personal information for marketing purposes during the preceding year.
